Corporate policy entrepreneurship and cross-boundary strategies: How a private corporation champions mobile healthcare payment innovation in China?

The private nature of corporate actors does not necessarily preclude them from contributing to public interest. When business strategies and genuine public motivation are favorably aligned, corporate actors from the private sector can also drive public sector innovations. For a private corporation, policy entrepreneurship inherently entails crossing not only the public–private boundary but also various policy domains. This study formulates five propositions to characterize the cross-boundary strategies of corporate policy entrepreneurship, a distinct form of policy entrepreneurship in a developing authoritarian state. The case study of mobile healthcare payment innovation in China finds that the corporate entrepreneur used a series of cross-boundary strategies adeptly that eventually made the innovation not only adopted in one locality but also rapidly diffused nationwide. These strategies were not used in isolation or in a pure stepwise fashion but appeared to be recursive and interactive, suggesting the dynamic nature of corporate policy entrepreneurship in a multilevel governance system. More studies could be done to further examine strategies and processes of other forms of policy entrepreneurship in various national and sectoral settings.     

Swedish crime scene technicians: facilitations,epistemic frictions and professionalization from the outside

ABSTRACT

This article investigates the role of crime scene technicians in the Swedish criminal justice system, and particularly how Swedish crime scene technicians not only examine crime scenes but also facilitate the criminal justice system’s joint production of forensic evidence. It proposes thinking about the criminal justice system as a conglomeration of epistemic cultures, that is, of communities with different ways of producing and understanding forensic evidence. Such a perspective makes it possible to understand interprofessional frictions as epistemic frictions as well as to draw attention to the facilitations, mediations and translations that crime scene technicians perform. This perspective also makes it possible to illuminate how the crime scene technicians’ professionalization – a professionalization from the outside – affects both their future crime scene work and their facilitations.     

The European lavender vote: Sexuality,ideology and vote choice in Western Europe

In many European democracies, political punditry has highlighted the attempts of political parties on the left to court the ‘lavender vote’ of lesbian, gay and bisexual individuals. This article examines the presence of a gay vote in Western Europe with a focus on assessing the role of sexuality in shaping individuals’ political preferences and voting behaviour. Empirically, the effect of sexuality on both ideological identification as well as party vote choice is analysed. Using a cumulative dataset of eight rounds of the European Social Survey between 2002 and 2017, this article demonstrates that partnered lesbians and gay men are more likely than comparable heterosexuals to identify with the left, support leftist policy objectives and vote for left-of-centre political parties. The analysis represents the first empirical cross-national European study of the voting behaviour of homosexual individuals and sheds new light on the importance of sexuality as a predictor of political ideology and voting behaviour within the Western European context.     

Violence on Iraqi bodies: decolonising economic sanctions in security studies

Abstract

United Nations agencies report that by 1998, Iraqi infant mortality had risen from the pre-Gulf War rate of 3.7% to 12%. Insufficient food and medical supplies and deterioration of sewage and sanitation systems and electrical power systems reportedly caused an increase of 40,000 deaths annually of children under the age of 5 and of 50,000 deaths annually of older Iraqis. Why is this violence on Iraqis absent from analyses of sanctions in international relations and security studies? This paper is concerned with, first, situating sanctions against the Global South as violence by challenging the conventional theorisation of violence inflicted by the hegemon as a mechanism of ‘national security’. Second, we offer a decolonial reading of the sanctions imposed on Iraq by shifting the locus of enunciation from the state to Iraqi people’s suffering.     

制度差异与制度创新:多元制度互动下的大湾区改革

在一国两制的背景下,香港、澳门与内地之间的制度差异如何影响粤港澳大湾区的发展?学界对此仍关注不足。论文基于制度主义理论,构建了"制度差异-张力-制度创新"的理论框架,以深圳前海自贸区的工程建设管理制度改革为案例,分析了制度差异推动改革创新的机制。研究发现,不同的制度逻辑形塑行动主体的认知与行为,因此多元制度在互动中能够产生张力,进而激发行为主体的能动性,促使其反思、设计新的制度、采取改革行动,最终促成制度创新。中国内地与港澳的制度在"一国两制"方针下得以多元共存,制度差异在粤港澳密切互动中产生的张力是大湾区改革的创新源泉,使大湾区在国家改革与发展大局中发挥重要作用。     

高绩效人力资源管理系统与员工创新行为 ：建言行为的竞争机制研究

如何促进员工的创新行为对组织的发展至关重要。本研究通过多源、多时点调研方式，对我国技术型企业的人力资源部门负责人及其下属员工进行问卷调查，探讨了组织实施的高绩效人力资源管理系统对员工创新行为的影响，并检验了促进性建言与抑制性建言的竞争性中介作用及心理安全感的调节作用。研究结果表明：组织实施的高绩效人力资源管理系统对员工创新行为有显著正向影响；促进性建言和抑制性建言在高绩效人力资源管理系统与员工创新行为间表现出部分中介作用；心理安全感调节了高绩效人力资源管理系统与促进性建言之间的关系；同时，心理安全感还调节了促进性建言对高绩效人力资源管理系统与员工创新行为关系的中介作用。     

人民法院改革取向的审视与思考

20世纪90年代以来的人民法院改革,总体上潜含着对标形式主义法治司法模式的取向,其目标可概括为“让司法更像司法”。这种由内向视角导引的改革,对塑造我国司法的基础形态、完善司法的基本要件具有积极意义,但也在一定程度上造成了司法与社会需求的疏离,使司法改革的红利难以充分转化为社会的实际获得。在还原主义立场下回溯司法的基源性理论,司法是一种制度建构的产物、一种公共产品,司法应当尊重“消费者体验”。着眼于外向视角,提升司法能力亦应成为法院改革的取向之一。在今后继续深化推进司法责任制改革的过程中,应以影响司法能力的基本要素作为改革的着眼点,通过司法能力的提升实现司法的社会功能,满足和实现社会对司法的需求,以“让司法更能司法”。     

浮动抵押逸出担保物权体系的理论证成

具有担保功能的权利,并非都是担保物权。如果一项权利既不符合担保物权的特征,亦有违物权法的基本原则,就不属于担保物权。对比浮动抵押与担保物权的特征可以发现,浮动抵押有担保功能但并非担保物权。在民法典编纂背景下,宜将浮动抵押从担保物权体系剔除。考察比较法资料,结合“charge”的词源语义,遵循语言翻译的忠实严谨原则,宜将“floating charge”译为“浮动担保”而非“浮动抵押”。至于浮动担保何去何从,相对合理的方案是将其嵌入合同法域,规定于我国民法典合同编之“合同的担保”章节,以此彰显民法典的体系性与逻辑性。     

新冠肺炎疫情期间公安法医应当加强尸体甄别和个体防护

因鉴定体制特点,公安法医除参与尸体有关的现场勘查工作外,还需进行尸体检验工作。在此过程中,可能面对很多风险,受伤和中毒等事件时有发生。然而,国内公安法医对新冠肺炎等传染病流行期间死亡的尸体如何甄别进行尸体检验鉴定,对现场勘查及尸体检验工作的防护只有少量规定,且内容不够详尽。本文对法医在现场勘查中遇到的尸体及尸体检验中实验室建设、职业现状、风险评估及防范措施等进行了论述。最后,建议出台相关的制度规定等具体约束规范措施,以保障公安法医现场勘查及尸体检验工作的顺利进行,以解除基层鉴定机构和鉴定人的后顾之忧。     

British Campaigns for Solidarity with Argentina and Chile

The Chile solidarity movement persuaded British Labour governments (1974–1979) to introduce a range of measures against the Pinochet regime. But campaigners lobbying against the Argentine dictatorship (1976–1983) had less impact on policy. Neither these Labour governments nor the subsequent Conservative government imposed any sanction on the Argentine dictatorship, until the invasion of the Falkland Islands. This article explores why in Britain – and Europe – the Chile campaign had greater public appeal than the Argentina solidarity campaigns. It identifies a number of common factors across Europe which explain why the anti-Pinochet cause generated more support than the Argentina campaign.
